Sanctity of apex court is out of question but the CJ has also to show respect to the sentiments of the affected families of the missing citizens – Coordination Committee


The Muttahidda Qaumi Movement’s (MQM) Coordination Committee has strongly condemned the postponement of the hearing of the cases of the disappeared citizens at the Karachi Registry of the Supreme Court of Pakistan.

The Committee has besides the condemnation called for concrete measures for the resolution of the agonies of the affected families whose family members have been enforced to disappear after they were kidnapped by the military forces and the law enforcement agencies. It also demand the SC to take extra high measures to resolve this anomaly once and for all.

It said that as per reports, the affected families of the missing citizens were asked by the Chief Justice of Pakistan to attend a meeting with him on the aforementioned issues of missing of citizens and hence the affected families had reached the SC’s Karachi Registry in compliance to CJ’s invitation with a hope for the safe return of their missing family members but as was expected the Police at the behest of the military force baton-charged the women, senescent and the children and forced them to get dispersed under baton-charge.

Sadly, the CJ commented that the affected families did not respect the sanctity of the apex court, the Committee deplored, adding that the demand sanctity of the court was valid but the CJ had also to give respect to the sentiments of the affected families who have suffered and he had also to play his constitutional role for the safer return of their missing family members to homes.

The Committee said there are numerous constitutional petitions (CP) pending with High Courts (HC) on which CJ was expected to seek explanations from those HCs about the fate of those CPs. However, instead of playing his constitutional role the CJ had on the pretext of sanctity of the apex court sought the expulsion of the affected families from the court premise. That act of the CJ stands very valid for due condemnation, it commented.

The Committee reminded the CJ that the father of the Mohajir Nation and Founder Leader of the Movement Mr. Altaf Hussain had in past and in recent days made repeated appeals to the CJ for a sitting together with the families of the missing citizens at any bigger venue like Jinnah Grounds in Azizabad or Bagh-e Jinnah adjacent to the mausoleum of founder of Pakistan Muhammad Ali Jinnah.

It said that it was very unfortunate that the CJ never attended to those just demands even on humanitarian grounds. The CJ failed to initiate reasonable steps for the safe return of the missing citizens to their homes.

It once again appealed to the CJ to spare some time and play his constitutional role for the recovery of the missing citizens.
