Honourable Justice Iftakhar Muhammad Chaudhry

Chief Justice of Pakistan

Assalam-o-Alaikum

After salutation I would submit that you cannot offer enough thanks to Almighty Allah for Balance of Justice that He has given in your hands. You have taken suo moto actions as the Chief Justice of Pakistan on a number of issues. I, Altaf Hussain s/o Nazeer Hussain (late), mother’s name Khursheed Begum (late), resident of R – 494/8 Azizabad, Federal B Area, Karachi and currently living in London at 3, High View Garden, Edgware, Middlesex, HA8 9UB, London, UK, the International Secretariat of the MQM situated at 54-58 High Street, First Floor, Elizabeth House, Edgware, Middlesex, HA8 7EJ, London, UK, petition you as a Pakistani, a human being and a Muslim to take action just as you have taken a number of suo moto actions in order to dispense justice, as follows.

Police, Rangers and other law-enforcing agencies carried out an unlawful and unwarranted raid at the residence of my 70 years old elder brother Nasir Hussain located at B- 54/13 on the night intervening between 5th and 6th December 1995 after 12 am in the night. They ransacked the house and arrested my 28 years old nephew Arif Hussain.

Arif Hussain had graduated from the NED University of Engineering and Technology with a BE degree in first class. He was supporting the house after completing his education through his job and by taking private tuitions because my elder brother Nasir Hussain, who had discharged duties as a gazetted officer on various government posts before he retired, was living a retired life. Nasir Hussain and Arif Hussain used to offer prayers five times a day regularly and they did not have any semblance of connection with any political or social organization, not even with the MQM. They had nothing to do with politics whatsoever.

My 70 years old brother Nasir Hussain was also arrested on the second after the arrest of Arif Hussain. My other brothers and sisters left their homes and shifted to the houses of their relatives after getting the information about the arrest of these two whereas the government agencies, along with the rangers, police and higher police official took my brother Nasir Hussain to the house of each and every one of my brothers and sisters for the purpose of arresting them as well. It was because of the grace of Almighty God that they had already left their homes and shifted to other locations. Finally the police, personnel of other law-enforcing institutions and agencies subjected both the father and the son to inhuman physical torture for three days. They were taken to Gadap in the outskirts of Karachi on the 9th December 1995 and killed in a brutal manner and their bodies were dumped there. We obtained their dead bodies from the Eidhi Centre and performed their burial. No one has paid any attention to the investigation of their murder despite repeated demands even as of today, Wednesday, 19th October 2011.

I, Altaf Hussain, implore and beseech Chief Justice Iftakhar Muhammad Chaudhry in the name of Allah and His Prophet (PBUH) with whose blessings and grace, he is placed on this position of honour, to solve the mystery of the barbaric and ruthless murders of my elder brother and nephew. If the honourable Chief Justice solved this mystery for upholding the rule of law and for defending justice, he would also come to know about the mysterious disappearance of thousands of arrested persons.

I am confident that the Chief Justice would start immediate proceedings by converting this humble entreaty and letter into a constitutional petition in order to untie the innumerable knots of the skein so that his name may be written both in this world and the Hereafter with honour and in exalted position.

May Allah be your Helper and Protector.
